These General Terms and Conditions (the “GTC”) govern the contractual relationship between Herr Informatik GmbH (“HERR INFORMATIK”, Windisch) and the customer regarding use of the Kisuno service. Based on the terms of Herr Informatik GmbH.
These GTC apply to all contracts for the use of Kisuno between HERR INFORMATIK and the customer. Deviating terms of the customer apply only where HERR INFORMATIK expressly agrees to them in writing.
HERR INFORMATIK provides Kisuno as a Swiss-hosted service or enables self-hosting under the MIT license. Model access runs either via the models from OpenAI (ChatGPT) and Anthropic (Claude), which run in the AWS data centre in Frankfurt, or via open models such as GLM, Kimi and DeepSeek, operated by European companies on servers in Europe. Scope and features follow the product description.
The contract is concluded upon registration or order and its confirmation by HERR INFORMATIK. The customer ensures that the data provided is complete and correct.
The managed instance costs CHF 7 (EUR 7.50) per person per month, excluding VAT. Through the end of the current month: 50 percent off with a twelve-month term, that is CHF 3.50 (EUR 3.75) per person per month. Testing is free and not limited in time; every new account starts with a starting credit of CHF 50 (EUR 55) for model usage, with no payment details required. The model credit is available to the organisation as a shared pool. When the credit is used up, a soft block takes effect: further requests are refused until the customer tops up the credit or expressly enables a cheaper fallback model in the administration. Without one of these releases, no additional charge arises. Invoicing is periodic and in advance.
The customer uses the service lawfully, keeps access credentials confidential and refrains from unlawful, infringing or abusive content and actions. The customer is responsible for the content it enters and for compliance with applicable regulations.
HERR INFORMATIK provides the service with reasonable care and strives for high availability. Maintenance, security and update windows may cause temporary interruptions. A specific availability (SLA) applies only under a separate agreement.
Processing of personal data follows revDSG and GDPR; details are set out in the privacy statement and the Data Processing Agreement (DPA). Customer data is not used to train models; telemetry is off by default. Operated in ISO 27001-certified data centres by Green (Lupfig).
The self-hostable software is provided under the MIT license, whose terms apply to that use. Trademarks, names, design and other marks of Kisuno and HERR INFORMATIK remain protected and are not transferred by the MIT license.
Within the statutory framework, the customer is responsible for backing up its data and adequately tests business-critical processes before productive use. HERR INFORMATIK assists to the agreed extent.
HERR INFORMATIK is liable under the Swiss Code of Obligations (OR). Liability for slight negligence as well as for indirect damages, consequential damages, data loss and lost profit is excluded to the maximum extent permitted by law. Mandatory statutory liability is reserved.
The contract runs according to the chosen billing period (monthly or annual) and may be terminated at its end. After the contract ends, customer data is exported on request and then deleted, unless a statutory retention obligation applies.
HERR INFORMATIK may amend these GTC. Changes are communicated to the customer in advance in a suitable form and are deemed accepted unless the customer objects within the notified period.
Swiss law applies exclusively, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is the registered seat of HERR INFORMATIK in Windisch (Canton of Aargau), to the extent permitted by law.
